Waiver, Liability Release, and Covid-19 Liability Release

Retreat Waiver and Liability Release

In consideration of my participation in this Racquet Retreats, LLC trip, I voluntarily elect to participate in this trip. I hereby assume all of the risks of participation, including but not limited to the risk of harm, danger, death, serious personal injury, illness, including but not limited to Covid-19 or other airborne illnesses, and personal property damage. I release, discharge, and covenant not to sue Racquet Retreats, LLC and the Coaches, their respective affiliates, officers, members, representatives, agents, clients, contractors, and employees from any and all liability, claims, losses, injuries, damages, costs, demands, or causes of action of any nature whatsoever which arise out of or relate in any way to my participation in the workouts, the activities, or anything else related to the trip. I acknowledge that this retreat may involve a test of my physical and mental limits, and I hereby certify that there are no health-related reasons or problems that preclude my participation in the workouts and activities, and that I have not been advised not to participate by a qualified medical professional. I understand it is my responsibility to consult my physician before beginning any exercise program or participating in an active retreat.

I acknowledge that this Waiver and Liability Release will be used by the retreat/event holders, sponsors, and organizers of the event, the workouts, and the activities in which I may participate, and that it will govern my actions and responsibilities. I hereby consent to the release of photos of myself and my likeness that may be taken during the retreat for use by Racquet Retreats, LLC and/or retreat partners. I hereby consent to receive medical treatment, which may be deemed advisable in the event of injury, accident, and/or illness during this activity or event. I acknowledge that Racquet Retreats, LLC has recommended I purchase a comprehensive travel insurance policy for this retreat. This Waiver and Liability Release Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19

Racquet Retreats, LLC will use its best efforts to institute and implement preventative measures to reduce the spread of COVID-19; however, Racquet Retreats, LLC cannot guarantee that you may not become infected, exposed, or otherwise contract COVID-19 while attending, participating in, or otherwise engaging in any activities at or in connection with Racquet Retreats, LLC.

Assumption of Risk / Waiver of Liability / Indemnification Agreement

In consideration of being allowed to participate in the Racquet Retreats, LLC retreat program and related events and activities, I acknowledge and agree that: Wearing a mask is NOT required by participants or group leaders unless dictated by the group leader or CDC at any given time. Participation includes possible exposure to and illness from infectious diseases, including but not limited to MRSA, influenza, and COVID-19. I will not attend the retreat or retreat activities if I am sick, have tested positive for COVID-19, or have been recently exposed to COVID-19; and, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and, I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and, I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Racquet Retreats, LLC, their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND AND AGREE TO ITS TERMS FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
